Federal judges in the district of New Jersey declined to extend Alina Habba’s appointment as interim US attorney on Tuesday, according to an order from the court.
In her ruling, U.S. District Judge Nancy Torresen called the executive order an unconstitutional infringement on free speech.
Judge Allison Burroughs, who noted in court that she is Jewish, said she would aim to rule quickly in the case.
Earlier this month, her attorneys said the court was rushing the process that could determine whether or not the government could seek capital punishment in the case. The government opposed that extension.
